PERMISSION FOR TRANSFER OF FLAT NO

 

1.         Reference your letter No____________________ dated_______.

 

2.         Permission for transfer of flat No ______________________ has been granted in principle as a special case.   Final permission can only be granted after submission and scrutiny of following documents :-

 

(a)        Certificate from HDFC/HBA (AG’s Branch)/ any other agency  certifying that the loan has been returned in full, in original.

           

            (b)        Agreement of allotment in original executed between you and AWHO.   If executed, in original.

 

            (c)        Booking and allotment letters issued in original.

 

(d)        Possession and handling/taking over certificate in original.

 

(e)        Final statement of accounts, alongwith all receipts for the instalments paid in original.

 

(f)         Registration application as per Master Brochure from the transferee ie______________________________ alongwith application fee of Rs_______/- in form of Demand Draft.

 

(g)        Two passport size photographs and two sets of three specimen signatures of the transferee both duly attested by a Class I Gazetted officer/Executive Magistrate (with his name and office seal).

 

(h)        No dues certificate from the Society concerned stating that the dues have been paid upto date and nothing outstanding.

 

(j)         Provisional membership of purchaser is required from __________________________________________(Name of Society).

 

(k)        Affidavits and Indemnity bonds and undertaking from the transferor and the transferee as per specimen enclosed.

 

(l)         An affidavit from the purchaser giving his/her property status in the country as per specimen enclosed.

 

3.         The affidavits and indemnity bonds as well as undertaking are to be executed on non- judicial stamp paper of an amount as prescribed in the state where the affidavit/indemnity bonds/undertaking are executed.  These are to be attested by first class Magistrate or Notary Public.   In case the attestation is done by the Notary Public, notarial stamps of Rs 5/- are to be affixed.

 

4.         All the documents must be executed by the parties personally and not through power of attorney.

 

5.         Transfer Charges at the rate of Rs 10,000/- each from the transferor/transferee.   The amount should be paid through separate A/c payee bank drafts in favour of Managing Director, Army Welfare Housing Organisation payable at New Delhi.

6.         This permission is valid for only 45 days from the date of issue of this letter ie ___________.    In case of failure to submit the document as above by due date to this HQ, the provisional sanction accorded as above would automatically deemed to be withdrawn.

 

7.         It may be noted that this is only a provisional sanction and final transfer will be carried only on receipt of all documents and their being in order.

 

8.         Managing Director reserves the right to reject any case at any stage without assigning any decision is binding and final.

Further, in terms of the Master Brochure as well as the letter of allotment of the aforesaid dwelling unit, I have sought the permission of AWHO to sell the aforesaid flat to Shri __________________________________. AWHO vide its letter dated _____________has given the permission in principle subject to submission of various documents by me and the purchaser to sell the aforesaid flat No ____________________.

 

3.         I state that I have received the full sale consideration from Shri _______________________ and state that nothing is due and outstanding from the purchaser, therefore, the money received by AWHO from me be deemed to have been paid by Shri __________________________ to AWHO, in respect of the said flat.

UNDERTAKING BY PURCHASER

 

 

1.         Whereas I,____________________________________ s/o_________________________ r/o____________________________________in an application made to the AWHO for purchase of flat bearing No______at__________floor situated in Sector_____________ (hereinafter called the flat/DU).

 

2.         AND WHEREAS, I, in my own interest, have applied to AWHO for the possession and immediate occupation of the flat allotted before completion  of the various formalities required to be performed by me pending execution and registration of the documents provided in the regulation of AWHO.

 

3.         I, ________________________________ s/o_____________________________________ r/o__________________________________________________ hereby undertake that in the event of the possession of the flat allotted being given to me earlier, I accept and agree that I shall abide by all the terms and conditions that are set forth in the Master Brochure Jul 87 (as amended), booking and allotment letter and all such rules, regulations to abide by the following terms and conditions of allotment :-

 

(a)        That I will not sublet, assign on part with any portion of the premises, allotted to me, except by way of proper legal tenancy.

 

(b)        That no additions and alterations in the DU including Car Garrage (CG)/ Scooter Garrage (SG) shall be made by me without prior permission in writing from the AWHO and the local Municipal/Civil authorities nor the flat will be used for any purpose other than residential purpose or amalgamated with any other dwelling units and it will not be sub divided.

 

(c)        That stair case, passages, road and other common area/convenience will be utilized by me alongwith other allottees of the flats and that I have no exclusive right to their use and I will use these common area/amenities without causing any inconvenience to other users.

 

(d)        That portions of the land not allotted to me in the residential scheme have either been allotted to some one else or kept reserved for “common use and services” which shall be managed by the registered cooperative society of which I am/will be a constituent part,  I shall in no way encroach upon the common portion of land area and services.  All unauthorized encroachment if any, are liable to be removed at my cost without any notice whatsoever.

                                                                                   

(e)        That the flat including car garage/scooter garage/extended car garage/  open parking spaces (as applicable)is meant to be used only for residential purposes by me, my family or by tenant and that laws of the Municipal Corporation/ Authorities concerned and byelaws of the cooperative society/in this behalf, would be complied with by me.  I will not use my flat including CG/SG/Open  Parking space for commercial purposes.

 

(f)         I am bound to and will become member of the Co-operative/welfare maintenance society of AWHO housing complex at _________________(Station).

 

(g)        I am satisfied with the cost of the dwelling unit as reflected in the FSA issued by HQ AWHO as also with further recoveries made on account of interest on delayed payment (as applicable).  I have no queries with regard to break down of cost, or any other claim in this regard.  I also undertake to pay within one month of demand any additional amount if demanded by AWHO as a result of discrepancies observed during reconciliation/audit of account pertaining to DU allotted to me by AWHO or any demand if made by land allotting authority.                                                   

 

(h)        I will pay my share of the cost of maintenance and upkeep of the flat/ house, stair case and the surrounding areas as determined from time to time by the concerned cooperative society.

 

(j)         Ground rent and Municipal Taxes will be paid by me when due to the co-operative society of the Authorities concerned.

 

(k)        When required to do so by the AWHO, I will get a conveyance deed or sub lease, as the case may be registered with the concerned authorities at my own cost and expense and in the event of authorities refusing to register the conveyance deed indemnify AWHO and hold AWHO harmless of all such claims and expenses incurred in registration of the house/flat.

 

(l)         After the sub lease or the conveyance deed is registered,  I will have no objection to AWHO depositing the said deed with the Housing Development Finance Corporation or any  other housing finance agency, as the case may be from whom I have taken a loan. 

 

(m)       That I accept, agree and undertake to abide by the rules published in the Master Brochure Jul 1987 and also as amended  from time to time, and the conditions of allotment as laid down in the booking letter and allotment letter, applicable to this flat.

 

(n)        That I will not sell/transfer/assign the dwelling unit to a third party without prior permission from AWHO/civil authorities concerned.  This will also apply to my heir, successors, executor and administrators.                                                                         

 

4.         It will be open to AWHO to cancel the allotment and resume the possession of the flat/house if I fail to fulfill the undertaking given herein above.
